1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of www.hollibae.com (the "Site"), operated by HOLLIBAE ("we," "us," "our"). By visiting or using the Site, you agree to be bound by these Terms. If you don't agree, please don't use the Site.
2. About the Site
The Site is a personal creator/streaming website for HOLLIBAE, providing information about streams and content, links to social and community platforms, and a merchandise store. Some features described on the Site (for example, the merch store's checkout) are currently demonstration previews and are clearly not processing real transactions until stated otherwise.
3. Intellectual property
The HOLLIBAE name, logo, branding, and all original text, graphics, photos, video, and other content on the Site (collectively, the "Content") are owned by HOLLIBAE or used under license, and are protected by copyright, trademark, and other intellectual property laws. You may view and share links to the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Content without our prior written permission.
4. Acceptable use
You agree not to, in connection with the Site:
- Use the Site for any unlawful purpose, or in violation of any applicable law;
- Scrape, crawl, or harvest data from the Site by automated means without our permission;
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
- Interfere with or disrupt the Site's operation, or introduce malware or harmful code;
- Impersonate HOLLIBAE or misrepresent your affiliation with us; or
- Use the Site to harass, abuse, or harm any other person.
5. Third-party links & services
The Site links to and embeds content from third-party platforms including Twitch, Discord, Instagram, and TikTok. These platforms are operated independently of HOLLIBAE, and your use of them is governed by their own terms of service. We aren't responsible for the content, policies, availability, or practices of any third-party platform, and linking to a platform doesn't mean we endorse everything on it.
6. Merch store & purchases
When the merch store is live and processing real orders, purchases will be subject to additional terms presented at checkout, including pricing, availability, shipping, and returns/exchanges. Product availability and pricing shown on the Site are subject to change without notice. Until the store is confirmed live for real transactions, nothing displayed in the store constitutes an offer to sell.
7. No warranties
The Site and all Content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We don't guarantee the Site will be uninterrupted, error-free, or free of harmful components.
8. Limitation of liability
To the fullest extent permitted by law, HOLLIBAE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of, or inability to use, the Site — even if we've been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Site will not exceed the amount you paid us, if any, in the twelve months before the claim arose.
9. Indemnification
You agree to indemnify and hold HOLLIBAE harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these Terms or your misuse of the Site.
10. Governing law
These Terms are governed by the laws of [YOUR STATE / COUNTRY], without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
11. Changes to these terms
We may update these Terms from time to time, particularly as new features (like a live merch store or membership perks) go live. We'll update the "Last updated" date above when we do. Continuing to use the Site after changes are posted means you accept the revised Terms.
